Attorney Michael Kunsch of MGC obtained a favorable defense verdict following a six-day federal jury trial in the Middle District of Pennsylvania (Williamsport Division) in a product liability case. The plaintiffs alleged that an assistant high school baseball coach suffered permanent loss of vision and psychological injuries after being struck by a batted ball, claiming a defective L-screen net. MGC represented the product distributor and argued that the plaintiff knowingly used the net despite prior visible damage.
While the jury found the product defective under strict liability, it also assigned 40% comparative negligence to the plaintiff on the negligence claims. The damages ultimately awarded to plaintiff were significantly less than the prior offers made during negotiation and approximately 10% of the lowest demand made by plaintiff during litigation.
