Attorney Emily Erickson of MGC secured a favorable result for her client in a jury trial before the Superior Court in McDowell County. The case involved a breach of contract dispute arising from a multi-state utilities project with multiple tiers of subcontractors. The Plaintiff submitted invoices that allegedly exceeded the agreed-upon scope and pricing for the work, and sought between $300,000 - $350,000.  Erickson argued that her client was not obligated to pay the disputed invoices, emphasizing both the lack of contractual privity and discrepancies between the billed amounts and the originally agreed-upon scope of work. She further demonstrated that one of the outstanding invoices had already been satisfied by a third party and that the Plaintiff’s unjust enrichment claim lacked legal support.

During trial, the court granted directed verdicts in favor of MGC’s client on the Plaintiff’s unjust enrichment claim and on one of the three contested invoices. Before the case was submitted to the jury, the matter resolved as to any remaining claims for a discounted amount due to the trial court’s rulings.
