Attorney Emily Hatem of MGC secured a defense victory before the North Carolina Industrial Commission in a highly contested workers’ compensation claim involving an alleged right-shoulder injury. Following a prompt investigation, the claim was denied based on the absence of a compensable injury by accident under state law. At mediation, the plaintiff voluntarily agreed to settle, executed a detailed Compromise Settlement Agreement and accepted payment. Months later, the plaintiff sought to undo the settlement, alleging misunderstanding and impairment during mediation. The Commission rejected these arguments, finding no evidence of fraud, misrepresentation, undue influence or mutual mistake. As a result, the agreement remained valid and enforceable, and MGC’s client faced no further exposure on the claim.
