Attorneys Christina Bisset and Harrison Berry of MGC secured a significant defense victory in Marion County following a three-day trial in a case involving an admitted liability auto-accident. The Plaintiff claimed extensive injuries and presented approximately $495,000 in medical expenses along with a $225,000 Life Care Plan for future treatment. The Plaintiff sought $1.25 million in damages at closing, after previously demanding the $500,000 UIM policy limits.

MGC represented the insurer, which carried  UIM coverage After filing an Offer of Judgment for $300,000—rejected by the Plaintiff—Bisset and Berry focused their defense on causation, arguing that the majority of the Plaintiff’s treatment was unrelated to the accident. The jury returned a verdict awarding $16,100 in economic damages and $50,000 for pain and suffering, for a total of $66,100—far below the Plaintiff’s demand. As a result of the set-off, MGC’s client owed no payment, and the Plaintiff is responsible for costs incurred following the rejected Offer of Judgment.
