MGC attorneys Chris Clark and Dominic Starr obtained a significant defense victory in Charleston County following a three-day jury trial involving claims of professional negligence of an insurance agent. The plaintiff alleged that its insurance agent failed to properly explain available code upgrade coverage and did not adequately advise the church regarding potential coverage limitations.
At the time of the loss, the plaintiff incurred approximately $1,069,000 in code upgrade costs but carried only $100,000 in coverage for those expenses, creating a claimed coverage gap of $969,000. The plaintiff sought to hold the agent responsible for the uncovered amount, alleging that proper advice and explanation would have resulted in the purchase of additional coverage before the loss occurred.
After three days of testimony and evidence, MGC successfully defended the agent against the claims. The jury deliberated for less than 30 minutes before returning a complete defense verdict in favor of the agent, rejecting the plaintiff's claim for $969,000 in damages.
