MGC attorney Erin McGonigle secured a significant victory in Fulton County in a jury trial involving claims for breach of contract, negligence and alleged violations of the Georgia Fair Business Practices Act.
During the course of the trial, MGC successfully obtained directed verdicts on the plaintiff's negligence claim and Georgia Fair Business Practices Act claim. Because the punitive damages claim was predicated on those causes of action, it was also dismissed before the case could be submitted to the jury.
With the plaintiff's claims substantially narrowed and its punitive damages exposure eliminated, the parties reached a favorable settlement on the fourth day of trial before the case was submitted to the jury.
